この提案に基づき、システム上重要な越境機関の監督権は各加盟国の主管機関からESMAに移管され、大型CASP、取引所、中央清算機関および中央証券保管機関を含むことになります。これは、2024年末にCASPに対して全面的に施行される《暗号資産市場規則》（MiCA）以来、EUの暗号規制の枠組みにおける最も重要な構造的調整です。
現行のMiCAフレームワークの下では、各国の主管機関が第一線の監督者として機能し、ESMAは調整役に過ぎません。
